The civil rights organisation AfriForum’s legal team today submitted their application for leave to appeal against the “Kill the Boer” hate speech case judgment at the High Court in Johannesburg.
In August 2022, the Equality Court declared that the chant, “Kill the Boer”, is not hate speech.
Ernst van Zyl, Campaign Officer for Strategy and Content at AfriForum, says that success in this appeal case is of great importance because the encouragement to kill or harm members of a group based on their identity is a serious matter that cannot be tolerated, especially in light of the farm murder crisis in South Africa.
“This appeal case is going to be an important indicator for us of the state of affairs as far as our political order is concerned. However, if the legal system turns its back when minorities are threatened and targeted with violence, the most important option that remains is that we have to look after our own safety,” concludes Van Zyl.
