Prevention and Combating of Hate Crimes and Hate Speech Bill

The South African government’s proposed Prevention and Combating of Hate Crimes and Hate Speech Bill will once again be open for public comment and appear before Parliament. While AfriForum supports sanctions on true hate speech, we believe this Bill distorts the meaning of the concept and constitutionally protected expression could be criminalised if the Bill is passed.

AfriForum believes that the current version of the Bill is unconstitutional and that it threatens freedom of expression because:

  1. freedom of expression is important for discourse in a democracy;
  2. legislation can be applied selectively to suppress freedom of expression; and
  3. many less limiting regulations can be considered to curb true hate speech.
