Success: AfriForum wins interdict against Department of Social Development in Sunfield Home case

The civil rights organisation AfriForum appeared in the High Court in Mpumalanga today, together with Sunfield Home, a home for the disabled, in their case against the Department of Social Development. Judge Roelofse has confirmed that he will grant an order prohibiting the department’s threat to relocate the Sunfield Home residents. The order, by Roelofse, includes the appointment of a lawyer with more than ten years of experience to act as curator ad litem for the residents. The judge will issue an order and written judgment by tomorrow, September 28, at 09:00.

From the get-go, the judge was convinced by AfriForum’s legal team’s court documents.

AfriForum intervened in the case after the state refused to increase the subsidy for Sunfield Home, a home for physically and mentally disabled people, for the past 14 years. The department threatened to displace the state-subsidised residents.

“This is a great victory in a David and Goliath story where the government treats the most vulnerable in our society unfairly and even threatens them,” says Ernst van Zyl, Campaign Officer for Strategy and content.

“Today’s victory emphasises the importance of civil rights organisations like AfriForum in a country with a government without a conscience,” concludes Van Zyl.
