Swart assault case transferred to Regional Court after Private Prosecution Unit intervenes

The criminal matter in which Nicolene Swart’s husband is being accused of assaulting her with the intent to do grievous bodily harm was today (on the instruction of the Director of Public Prosecutions in Gauteng) in the Pretoria North Magistrate’s Court transferred for trial to the Regional Court. The trial is expected to proceed on 7 to 9 June 2022.

This follows after the trial was postponed on several previous occasions and the matter was, at one point, struck off the roll. AfriForum’s Private Prosecution Unit, in terms of a watching brief from Swart, made representations to the DPP and also indicated that they were prepared to institute private prosecution. Thereafter, the DPP instructed in May 2021 that the accused must be summarily prosecuted.

“We welcome the transfer of the matter to the Regional Court given the seriousness of this case of gender-based violence. We will continue to support the complainant in the matter and ensure that justice is done,” says Adv. Gerrie Nel, Head of AfriForum’s Private Prosecution Unit.
