Constitutional Court dismisses EFF’s application for leave to appeal in AfriForum land invasion case

The Constitutional Court today dismissed Julius Malema and the EFF’s application for leave to appeal against an interdict which AfriForum acquired in 2017, which prohibited Malema and the EFF from inciting people to trespass on private property and to illegally occupy it. In January 2023, Malema and the EFF applied for leave to appeal in this case at the High Court in Pretoria. The High Court dismissed their application which prompted the EFF to approach the Constitutional Court with this matter.

“The implications of Malema and the EFF’s intense desperation to have this land invasion judgment overturned, are troubling. Why is the EFF so determined to be able to incite lawlessness?” says Ernst van Zyl, Campaign Officer for Strategy and Content at AfriForum.

“This ruling is however yet another major win for the right to private property and a devastating loss for those who wish to incite criminality and violence. AfriForum welcomes the Constitutional Court’s reaffirming of the High Court’s strong judgment against the incitement of land invasions,” Van Zyl concludes.
