Diesel and coal contracts: Court orders Eskom to disclose withheld information

The Gauteng High Court in Pretoria today ordered Eskom to disclose requested information regarding its existing coal and diesel contracts to AfriForum. The judgement follows after Eskom – without sufficient explanation – refused to disclose the information to the civil rights organisation after an application in terms of the Promotion of Access to Information Act (PAIA) was submitted in July 2022. AfriForum suspects that the information contained in these contracts may reveal possible irregularities and corruption at the power utility.

AfriForum maintains that Eskom, being one of the country’s largest and most important state-owned enterprises, has a legal obligation to operate transparently and responsibly. Therefore, AfriForum believes that the information contained in these contracts should be made public.

Eskom has until 5 April 2024 to deliver the information to AfriForum. Meanwhile, the civil rights organisation is putting together a specialised team of industry and law experts who will carefully analyse the contracts over the next few months. If any irregularities are found in the contracts, AfriForum will campaign for strict action against the state-owned power utility.

Louis Boshoff, Campaign Officer at AfriForum, welcomes the court’s ruling and describe it as a victory and a crucial step towards accountability and transparency in South Africa’s energy sector. “Rolling blackouts have plagued South Africa for far too long. Citizens deserve a power utility that operates with integrity, not one embroiled in corruption and mismanagement.”
